But there is a difference. While the other states allow an officer to ticket a motorist caught using a hand-held cell phone while driving, Washington's law makes it a secondary offense. This means an officer can't pull you over solely for that reason, but he can write you up if he stops you for another violation, such as speeding or running a red light.

What a stupid ass law. Of all the ignorant shit I see on the road reading books/newspapers, putting on makeup, texting, looking for the dropped cigarette, etc etc etc. Thank god for communism. We are getting closer. I need a law that tells me when I can take a shit...Fucking people that can't take care of themselves and need government ot do it for them. If your dumbass can't stop talking and pay attention ot the road for a minute when something potentially deadly is happening, I say you probably don't need ot be spreading your genes anyway.

Actually - Washington has a law that covers all that other extraneous shit. It's called 'Driving while distracted'. That's been on the books for about 10-years now. I wonder how many times that's actually been envoked?

Same down here in Cali.

I just made my work spend about $150 on a BlueAnt since I refused to be an ear piece wearing douchebag....and of course they also had to spend another $200 on me to upgrade to a blue tooth phone.

Seriously, other than dialing or texting, is it any more distracting talking on the phone while driving than it is talking to your passenger? At least while on the phone you are not looking at the phone while you are talking on it like people do while talking to a passenger.

Instead of ticketing people they should just make more people held responsible for their actions. If you wreck while on the phone due to inattention, then deny the insurance. But that will never happen since we all know the tickets are just another form of generating revenue for the local governments.

Been like that here in NY for a couple years I think. Except here they will pull you over for just the phone. In WA it sounds like they will need to come up with a couple other things to nail your ass for just so they can give you the phone ticket.

The difference is that with the passenger, they're sitting there with you, and can also see out of the dashboard. So, if there's a moment when you need to focus on driving, or an OH SHIT moment, they'll shut up and let you do your thing.

On the phone...they don't know WTF is going on.

And, if you are holding the phone with one hand, you only have one hand to hold the steering wheel. Unless you are being really friendly with your passenger, you should have both hands available to grab the wheel.

If you try real hard I am sure you can think up a few reasons why holding a cell phone while driving can be distracting. The most obvious: How do you shoot some one the bird while one hand is on the wheel and the other is holding the phone? It is considered proper etiquette to say excuse me to the person on the phone before yelling obscenities out the window. It is even better if you press the mute button before the barrage. Unfortunately only the elite can accomplish that move so that it is seamless and uninterrupted.

I know someone who was hospitalized on April Fools day.. cuz she was texting while driving, and she rear ended someone.. she also wasnt wearing her seat belt..

I think she got away to easy.. after all the people that were getting after her, I dont know if she has changed her ways yet or not..

Clips on the visor, so I don't have to have one of those ridiculous earpieces. The wife says it sounds a little scratchy, but what do I care? We can understand each other, and that's what really matters.

The law went into effect in California as well. I have to say I didnt see anyone on their phone in the car on July 1st but as it was the first day Im sure everyone knew cops were looking.

But as I understand the law you are still able to text message while driving. ARE YOU KIDDING ME!!!! Thats going to cause more accidents than holding the phone while talking.

I think it was a mistake when the law was made and no one thought about text messaging as there is no mention of it in the law. Thats got to be changed fast.

If Im wrong......PLEASE someone tell me.

I know in Washington text-messaging has been illegal for, oh, over a year I think. I *believe* its also a primary offense, but I'm not 100 percent on that one.

I don't know about California, but I know your legislators love to make things illegal, so if not, its only a matter of time.

I've only had a motorcycle for 2 weeks, and I've already been been almost rear-ended and swerved into more times by people talking on their cell phones more time than I'd like to count. The next car that drifts into my lane gets their door kicked in.
